& Privacy Notice
This privacy policies (“Privacy Policy”) applies to you as our clients, potential clients, service providers or any parties (including their employees, clients, agents, representatives, etc) who may provide their personal data to Chung Chambers (hereinafter referred to as “we, “our” or “us”) pursuant to the requirements of the Personal Data Protection Act 2010 (“PDPA”) in Malaysia.
1. Personal Data
You may provide data and information about yourself, your organisation, your employees, your clients and/or any third parties to enable us to enter into transaction with you or to deliver the necessary services and/or requests in connection with our services and business.
Such personal data may include but not limited to information such as name, national registration identity card number, passport number, age, contact number, residential address, e-mail address, birth date, gender, occupation, designation, bank account details, information of spouse/ children such as name and birth date, information as to physical or mental health, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of an offence and other such data necessary for the performance of our services to you. Aggregated data which shall include analysed data and anonymised data is considered non-personal data for the purposes of this Notice.
2. Purpose of Collection, Use and Processing
Chung Chambers strive to collect only the necessary Personal Data when you: create an account with us, register with us, enrol in a webinar at Chung Chambers, subscribe to Chung Chambers newsletter, reach out to us (including via social media), take part in an online survey, or engage with Chung Chambers in any other way. In doing so, we may collect various types of information including:
a. Account Information: Your personal details, including user name to access your account on our website, age, gender, address, phone number and email address.
b. Contact Information: Data such as name, date of birth, gender, email address, mailing address, phone number, car registration plate number or other contact information that allows us to reach out to you during emergency situations.
c. Financial Information: Details including salary, income and assets information will be collected.
d. Payment Information: Data about your billing and method of payment, such as bank details, credit, debit, or other payment card
e. Government-isued ID Data: As we may need to verify your identity, we may ask for a government-issued ID in limited circumstances, or as required by law.
f. Fraud Prevention Information: Data and information used to help identify and prevent fraud.
g. Other Information You Provide to U Details such as the content of your communication with Chung Chamber, including interactions with and contacts through social media channels including any other information as required by us from time to time for the purposes specified in Clause 5.
3. Primarily, our website is informational in nature. We do not collect any Personal Data or personally identifiable information when you visit our website unless you choose to provide that information to us. We may collect information that personally identifies you if you choose your personal data for the various purposes made available on our website. You are not required to provide the above personal data (“Personal Data”) that we have re However, if you choose not to do so, in many cases we will not be able to provide you with our products or services or respond to requests you may have.
4. Disclosure and Transfer of Data
Chung Chambers shall not disclose any of the Personal Data to any third party without your consent except to parties mentioned in this Notice, and does not share your Personal Data with any third parties for their own marketing purposes, subject to the Purposes herein.
However, we may disclose the Personal Data in good faith, among others, our employees, any of our existing or future related, affiliated or associated companies/parties or to any other third parties such as auditors, professional consultants or advisors (including other law firms), accountants, agents, service providers, insurers, Bar Council, governmental bodies and authorities or any other third parties as may determine to be necessary or appropriate in order to satisfy the purposes for which the Personal Data have been collected and is necessary to comply with any government or law enforcement agency requirements, court orders or legal process, or if required by law.
Personal Data may also be transferred outside Malaysia in accordance with the requirements of the PDPA.
Notwithstanding the parties/ bodies aforementioned, there will be situations where a disclosure is necessary or compel by the law. In such scenarios, such disclosure is only limited where Chung Chambers deems fit.
5. Processing of Personal Data
a. Chung Chambers process Personal Data to facilitate provision of our services, to conduct our business and other incidental matters relating to our services and operation, to process your transactions, to communicate with you, for security and fraud prevention, and to comply with law. We may also use Personal Data for other purposes with your consent.
b. Depending on the circumstances, Chung Chambers may rely on your consent or the fact that the processing is necessary to fulfil a contract with you, protect your vital interests or those of other persons, to comply with law or client relationship management (including sending updates, information relating to our services and business, services offered by third parties, events invitation, newsletter or any other related materials. We may also process your Personal Data where we believe it is in our or others’ legitimate interests, taking into consideration your interests, rights and expectations including obtaining feedback for participation of our events or our services, or submission to entities such as the Legal 500, Asialaw, Asian Legal Business, Chambers and Partners, etc for evaluation and ranking of our legal services and law firm.
c. The Personal Data previously collected from you is being, and will continue to be, processes by Chung Chambers for, among others, the following purposes: (“Purposes”):
i. Client Onboarding: Chung Chambers collect such Personal Data to facilitate Client onboarding process, Chung Chambers process these Personal Data to confirm eligibility of the Client.
ii. Client Verification: Chung Chambers engages in the processing of such Personal Data to maintain a secure , this ensures the accuracy of academic records, facilitates secure access to campus facilities and online resources, and enables effective communication between Client and Chung Chambers.
iii. Payment Processing. Chung Chambers will be required to collect your Personal Data for the purpose of identifying you as a payer, authorised and processed the payment. In certain circumstances, the Personal Data will be processed to comply with the law and regulations.
vi. Communicate with you. To respond to communication, reach out to you about your transaction, account and case, market our services, provide relevant information, or request information or feedback. From time to time, we may use your Personal Data to send important notices, such as communications about your case update and changes to your terms, conditions and policies.
v. Security and Fraud Prevention. Your Personal Data will be processed to protect individuals, Chung Chambers’ employees, and Chung Chambers and for loss prevention and to prevent fraud, including to protect individuals, Chung Chambers’ employees and Chung Chambers for the benefit of all our users, and pre-screening or scanning uploaded content for potentially illegal content, including child sexual exploitation materials.
vi. All other pruposes necessary and/ or incidental to our business and all purposes necessary for or related to any of the above purposes.
6. Consequences for Not Providing Personal Data
In any event, you fail to consent the processing of your Personal Data by us, we may not able to:
a. provide the services requested;
b. respond or handle any of your queries and requests; and
c. send updates, information relating to our services and business, services offered by third parties, events invitation, newsletters or any other related materials.
7. Choices and Rights of Access and Correction
You may also withdraw your consent or restrict the purposes and methods in which we process your Personal Data and the personal data relating to other persons who may be identified from your Personal Data.
You have the right to request access to and correction of Personal Data held by us by virtue of the provisions of the PDPA. Subject to the fee payable and the provisions of PDPA, you may request access to your Personal Data and check whether any of your Personal Data is being processed. You may also request that we correct any Personal Data that is inaccurate, incomplete or out-of-date.

8. Personal Data Protection and Privacy Notice
The Personal Data Protection and Privacy Notice will be reviewed and updated from time to time to reflect the changes in law and/or regulatory compliance practices. You may request the latest version of the same, if any, by contacting us or visiting our website: www.chungchambers.com. By continuing to instruct us, you are deemed to have accepted this Personal Data Protection and Privacy Notice and the revised and updated version (if any) and consented to the processing of your Personal Data.
1. Retention of Personal Data
a. Chung Chambers will not retain any Personal Data for a period longer than is necessary for the fulfilment of the Purposes for which it is to be processed. We will take reasonable steps to ensure the erasure of such Personal Data, for which they were collected or processed, and unlawfully processed, without undue delay. For the avoidance of doubt, the Personal Data will only be retained for the period so long as you are engaged with Chung Chambers unless Chung Chambers is legally obligated to keep a record to comply with the law.
9.Your Rights
a.With respect to Processing of your Personal Data and subject to any statutory exemptions, you have the right to request regarding your Personal Data from Chung Chambers, including
i.Accessing, obtaining a copy, updating, or correcting the Personal Data listed herein;
ii.Requesting Chung Chambers to limit the processing and use of the Personal Data;
iii.Request for erasure of Personal Data without undue delay by withdrawing your consent; and
iv.Request to receive an electronic copy/ machine readable copy of your Personal Data for purposes of transferring it to another company.
b.Any request that you made in relation to your rights as stated above must be made in writing and may be subject to a fee requirement under the PDPA if such requests are manifestly unfounded or excessive, in particular because of their repetitive character. If you wish to exercise such rights and request access to your Personal Data, please contact our Data Protection Officer, contact details provided in Clause 12 below (see Contact Us).
c.There may be situations where we cannot grant your request – for examples, if you ask us to delete Account Information while you are still engaged with our services and where Chung Chambers is legally obligated to keep a record to comply with law. We may also decline to grant a request where doing so would undermine our legitimate use of data for anti-fraud and security purposes, such as when you request deletion of an account that is being investigated for security concerns.
10. Data Security
As we are committed to protecting your Personal Data, we will take all reasonable steps to safeguard your Personal Data from any loss, misuse, unauthorised or accidental alteration or destruction, when processing your Personal Data including ensuring your Personal Data is stored properly in accordance with the requirement of the PDPA and ensuring our employees do not misuse your Personal Data.
As such we instil the importance of data confidentiality among employees. All our employees involved in the processing of Personal Data are registered to assure their accountability with the Personal Data they have access to and prevent misuse of Personal Data and unauthorised transfer. We are constantly working to improve on these safeguards to help keep your Personal Data secure.
Any of the Personal Data provided to us are stored on secure servers. However, the nature of the Internet is such that we cannot guarantee or warrant the security of any information you transmit to us via the internet. No data transmission over the Internet can be guaranteed to be 100% secure. However, we will also apply and maintain an appropriate security procedure to manage and protect the use and storage of records containing your Personal Data, and this includes regularly reviewing and updating the technical and organisational security measures governing the processing of Personal Data to be carried out.
We will not retain any Personal Data for a period longer than is necessary for the fulfilment of the purpose for which it is to be processed. We will take reasonable steps to ensure that such Personal Data is destroyed or permanently destroyed if it is no longer required.
To ensure the security and privacy of your Personal Data, we will/ have appoint/ appointed a Data Protection Officer (“DPO”) who will oversee data handling in accordance with data protection laws, develop policies, assists with inquiries and address concerns regarding your Personal Data.
11. Data Breach Notification
While Chung Chambers commits in the effort of making sure your Personal Data is secure, Chung Chambers will communicate to you if there is any Personal Data breach to you without undue delay. 13. Cross-Border Transfer of Personal Data
Your Personal Data may be transferred to or accessed by our affiliates, in order for us to fulfil the Purposes and to perform processing activities described in this Notice and Privacy Policy in connection with your use of our services. Chung Chambers complies with laws on the transfer of Personal Data between countries to help ensure your data is protected, whichever it may be.
Chung Chambers shall take reasonable steps, including technical measures, to inform any third party which are processing the Personal Data that the request to erasure of Personal Data of any links to, or copy or replication of, those Personal Data. In such events where the rectification or erasure of Personal Data or restriction of processing is completed, Chung Chambers or the third party shall communicate any rectification or erasure of personal data or restriction of processing carried out to the person request for erasure, unless it is impossible to carry out or involves disproportionate efforts.
